Agent Splitter
Terms of Service
Last updated: August 19, 2026
1. About these Terms
These Terms of Service govern your access to and use of Agent Splitter, including its website, account features, commission-tracking tools, subscription features and related services (the “Service”). Agent Splitter is operated as a sole proprietorship based in South Africa.
By creating an account or using the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.
2. Who may use the Service
You must be at least 18 years old and legally capable of entering into a binding agreement. The Service is intended for individual real estate sales agents and is not intended for brokerage-wide payroll, accounting or commission administration.
3. What Agent Splitter does
Agent Splitter provides tools for independently recording, forecasting, calculating, comparing and retaining information about real estate sales commissions. The Service can help you track expected commission, brokerage-approved or final commission, amounts paid, outstanding amounts, adjustments and cap or threshold information.
Agent Splitter is an independent record-keeping and calculation tool. It is not a brokerage system, CRM, accounting service, payroll provider, tax service, legal service, escrow service, MLS service or payment processor for real estate commissions.
4. Your responsibility for commission information
You are responsible for the accuracy and completeness of information you enter into the Service, including sale prices, basis amounts, percentages, adjustments, brokerage-approved amounts and payment information.
Calculations and forecasts produced by Agent Splitter depend on the information you provide. They are estimates and records for your own use and do not determine what commission you are legally or contractually entitled to receive. Your brokerage agreements, applicable laws and actual payment records remain controlling.
You should review important financial results before relying on them. If a calculation appears incorrect, you should verify the underlying transaction data and applicable brokerage documentation.
5. Accounts and security
You must provide accurate account information and keep your login credentials confidential. You are responsible for activity performed through your account unless it results from a security failure attributable to us.
You must notify us promptly if you believe your account has been accessed without authorization. We may restrict or suspend access where reasonably necessary to protect the Service, users or data.
6. Subscriptions, trials and billing
Agent Splitter may offer a free trial followed by a paid subscription. The subscription price, billing frequency and applicable trial period are shown before you subscribe. Unless otherwise stated at checkout, subscriptions renew automatically at the selected billing frequency until cancelled.
Payments are processed by an external payment provider. Agent Splitter does not store your full payment-card number or card security code.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current paid billing period unless applicable law requires otherwise. You retain normal access until that period ends. A failed recurring payment may result in a temporary grace period followed by restricted access if payment remains unresolved.
Subscription cancellation, payment failure or subscription expiry does not by itself delete your stored commission records.
7. Your data
You retain ownership of the transaction, commission and other content you enter into the Service. You grant us permission to host, process, back up and otherwise use that content only as reasonably necessary to provide, secure, maintain and improve the Service and to comply with law.
You may request export or deletion of your account data using the functionality provided by the Service, subject to records we are legally required or reasonably permitted to retain.
8. Acceptable use
You may not use the Service to break the law, infringe another person’s rights, introduce malicious code, interfere with the operation or security of the Service, attempt unauthorized access, scrape or probe the Service in a way that materially burdens it, or use another person’s account without permission.
You may not reverse engineer or attempt to extract non-public source code except to the extent that applicable law expressly permits that activity despite this restriction.
9. Availability and changes
We aim to keep the Service available and reliable, but uninterrupted or error-free operation cannot be guaranteed. Maintenance, security events, third-party outages and technical failures may temporarily affect availability.
We may change or discontinue features where reasonably necessary. We will not intentionally use feature changes to deprive you of access to your retained data without providing a reasonable means of retrieving it, except where access must be restricted for security, legal or account-status reasons.
10. Suspension and termination
We may suspend or restrict an account that violates these Terms, creates a security risk, is used unlawfully, or requires restriction to comply with law. Where appropriate, we will give notice and a reasonable opportunity to resolve the issue.
You may stop using the Service at any time and may request permanent account deletion through the available account controls. Ending your account does not remove obligations or liabilities that arose before termination.
11. Disclaimers
To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis. We do not warrant that calculations, forecasts or records will be error-free, complete or suitable for a particular legal, tax, accounting or contractual purpose.
Nothing in the Service is legal, tax, accounting or financial advice. Agent Splitter does not interpret commission agreements or determine whether any compensation arrangement is lawful or enforceable.
12. Limitation of liability
To the maximum extent permitted by law, Agent Splitter will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, business opportunity, data or anticipated commission arising from your use of or inability to use the Service.
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service will not exceed the amount you paid for the Service during the twelve months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
13. Governing law
These Terms are governed by the laws of South Africa, without regard to conflict-of-law principles. The courts of South Africa will have jurisdiction over disputes relating to these Terms or the Service, except where applicable law gives you a mandatory right to bring a claim in another jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. If a change materially affects your rights or obligations, we will provide reasonable notice through the Service, by email, or both. The updated Terms will state their effective or last-updated date.
